Call For Renewal Of Rent Regulation’s In A Press

Memo to Albany: Renew and reform rent regulations

Affordable housing and other protections available to low-income tenants Downtown and citywide might disappear, if the state rent regulation law expires in June. State Assemblymembers representing four of the five boroughs held a hearing at 250 Broadway last Thursday, where several city housing advocacy groups and tenants testified about the importance of renewing the Emergency Tenant Protection Act, which applies to all buildings built in New York City before 1974. They are also lobbying for passage of the omnibus bill, which would make the E.T.P.A. effective in all city buildings. Brooklyn Assembly Member and Housing Committee Chair Vito Lopez, who led the hearing, said there is a “major battle” going on between landlords seeking to deregulate the rents in their buildings, and tenants who are being driven out of their homes due to escalating rents. Strengthening rent regulation laws is a must, according to Manhattan Legal Services, an organization based in Lower Manhattan that offers legal services for low-income Manhattan tenants. Available rent-stabilized housing is becoming more and more scarce, causing low-income residents to live in households of three or more and save on basic necessities such as food to be able to afford escalating rents. Under the current law, owners of rent-stabilized apartments must submit documentation each year to the New York State Homes and Community Renewal agency. Tenants are entitled to lease renewals with succession rights to family members, and they can report complaints about landlord harassment, rent overcharges and poor living conditions to the agency. If a tenant’s rent exceeds $2,000 per month, and the household income exceeds $175,000 for two consecutive years, the landlord can be granted high-rent/high-income decontrol, per state approval. The state vacancy decontrol law, meanwhile, enables landlords to permanently take vacant apartments out of rent regulation. They can also deny new, free-market tenants lease renewals their predecessors had received when that same apartment was rent-stabilized. Both forms of rent decontrol often cause low-income tenants to vacate their apartments, because they can’t afford to pay the higher rents. But landlords can quickly find other tenants willing to pay market rates to occupy the units, leading to a loss of affordable housing and low vacancy rates. The state law allows cities of one million people or more that have vacancy rates of five percent or less to declare a housing emergency, allowing municipalities such as NYC to implement the E.T.P.A. According to the 2008 NYC Housing and Vacancy survey, the vacancy rate for regulated apartments in Lower Manhattan up to 14th street was one percent, plus or minus 1.2 percent. The vacancy rate for unregulated apartments was 4.7 percent, plus or minus 2.7 percent. Community Board 1 drafted a resolution at an affordable housing task force meeting Monday evening that calls for Governor Andrew Cuomo to renew and strengthen the state’s rent stabilization laws. It also asks to enforce stabilized housing through law, rather than give owners tax reductions that “limit the life of stabilized units.”

Water In A Press

At 6PM The Water Finally Is Flowing To My Kitchen Sink. Both The Hot And Cold Water Came Out Black From The 1920’s Rusty Pipes. Wow That Was a Sight!

The Weather Has Risen To 34 Degree’s. A Little Above Freezing, Giving The Water Pipes A Chance To Thaw Out.

I Informed Ms. Huerta And Sent Her An E-mail To Schedule The Necessary Repair’s.

I Had To Add That The Heat Went Off At 4PM This Afternoon, And It Is Now 4AM And Still No Heat.

It Is Like Jumping From The Frying Pan And Into The Fire. I Am Exhausted And A Little Sick And Tired Of These Undelivered Service’s.

Let Me See When The Heat Comes Up.

At This Point I Am Going By The Letter Of MY Lease! Games Are For Children. I Have Been Paying, Fixed Income, U.S. Dollar’s For This Apartment.

It Is Now 24 Hour’s Since I Contacted Soraya Huerta/Property Manager For Lin’s Realty,LLC.

Yesterday She Sent An Unlicensed Individual To Check The Hole Under The Sink.

Mind You He Came Without Any Tool’s Of His Own, And The Baseboard Had To Be Unscrewed From The Cabinet.

That Job Was Left To Me. So Impatient Was He That He Was About To Leave Before I Unscrewed The Second Of The Two Screw’s That Held The Baseboard In Question.

Upon His Inspection, He Gasped,(Sic) And Confirmed My Allegation Of This Hole In The Wall.

I Led Him Down To The Basement Where The Culprit Of My Thorn Was, The 4 Inch Pipe That Descended From The Nefarious Hole In The Wall, Under The Kitchen Sink.

I Pointed Out To This Young Man The Pieces Of Insulation Dislodged By What I Dare Say, Big Grey City Rat’s, That On Occasion, Scamper Through The Wall’s Crevice’s At All Times During The Wee Hours Of The Night.

After Acknowledging That Yes, Indeed This Was The Same Pipe That Lead’s From The Now Frozen Smaller Kitchen Pipe’s, I Suggested That He Move The Haphazardly Placed, And Insufficient Fibrous Insulation Around, So As To See The Extent Of This Hole, That For So Long Has Caused Me Great Consternation.

He Stated In A Definitive Tone, I’m Not Touching That, Because Then I’ll Start Itching.

After About Four Minutes Of Visually Scanning The Rest Of The Basement Cealing He Promptly Left Without A Thought About The Frozen Pipe, That Is The Reason For My Call To Ms. Huerta.

So Here I Am In My Kitchen Table Having Just Made Another Call To HPD, To File A Complaint For Frozen Pipe’s As Per The Advice Of The 311 Operator, The Day Before.

Woo Hoo, WOW, Wee! How About That.

The Real Estate Board of New York banquet, sometimes called the “Liar’s Ball” for all the hot air it produces, is the biggest party of the year for the business of building, buying and leasing New York.

The   Rotten   Apple   And   The   Culprit!


The average real estate executive is against all of that, but they have to get along. Developers need city approvals for almost everything they do. The pols who give the approvals need cash to run for higher office. And the developers have cash to give.

So there was City Council Speaker Christine Quinn, an ardent supporter of rent regulation. She also controls the Council’s development agenda, and has raised oodles of cash from real estate as she prepares to run for mayor.

Other politicians showed, too – Council members, Sen. Chuck Schumer, state Senate Republican leader Dean Skelos – to court the only business in town that can never move away.

“They show up here because everybody shows up here,” said REBNY President Steven Spinola. “I believe we’re the most important industry in the city.”

DOWNSTAIRS in the Hilton lobby, a small group of protesters complained that REBNY is pouring money into the Committee to Save New York, which is backing Gov. Cuomo’s fight to cut union benefits, slash spending and not raise taxes.

“Hey, you millionaires: Pay your fair share!” they shouted – not loud enough to be heard in the ballroom – before security chased them out.

Of Course I Called The Landlord This Morning As Well As The Property Manager.

Not Until 4PM Did She Send Someone To, Once Again Check Out The Problem.

But This Time I Unscrewed The Base Board So That He Can Take A Good Look.

I Guess That He Did By The OH! Coming From His Throat And The Look In His Face.

They Came After I Called 311/HPD. Only God Know’s When This Maintenance Problem Will Get Corrected/Resolved.

Last night and tonight were a Code Blue for the city’s Department of Homeless Services.
Hundreds of New Yorkers have called 311 to report neglectful landlords who have forced tenants to shiver in unheated apartments. And the city’s Homeless Services department has had to trigger its emergency Code Blue procedures 41 times so far this winter. At this time last year, Code Blue had been called 32 times. (NYDN)

Funny That Our Infamous Slush Fund Speaker Christine Quinn Just Had A Press Conference Extolling Her Committment To Compel Slumlord’s To Maintain Their Properties Under Penalty Of Law….Empty Word’s Full Of Hot Air From One Who In 2009 Gave Appointed To Her And Her City Council Carpetbagger’s A Third Term In Office, And The Now Infamous Skirting Of 2 Citywide referendum’s Limiting Term Limit’s To Only Two Term’s. 

Shall I Call HPD?

Will It Make A Difference?

Will They Act Now That Quinny Has Put Her Bigfoot Down?

Yeah Right, Only When Her Ancestor’s Those Flying Pig’s Fly!

It Is 16 Degree’s And Well Here We Are Once Again With Frozen Water Pipes. Having Previously Informed The Landlord And Property Manager That The Repair’s Made Previously Were Insufficient And Would Lead To Future Call’s To HPD Concerning This Ongoing Issue With Frozen Pipes, Because The Cause Of The Frozen Pipes Were Due To No Insulation On The Pipes Or In The Wall’s Where The Pipes Lead To The Basement Celler And Are Exposed To The Outside Environment.

Of Course They Chose To Ignore My Contention’s As All Slumlord’s Do When They Scrimp On Property Repair’s. Now Here We Are Again. I Have Contacted The Corrupt City Agency Responsible For Inspecting Residential Building Maintenance Complaint’s, Also Known As HPD, But Knowing What I Know, They Will Falsify Their Records To Show That They Inspected And Found Nothing To Warrant An Issuance Of A Housing Code Violation…One Wonders If This Is The Reason Why The Advertisement Billboard Keeled Over On The Brooklyn Queens Expressway Overpass And Adjoining Business’, In Williamsburg Last Week.

The Landlord And His Father In Law Are At This Moment Under The Sink, Replacing The Flexible Water Line. However They Are Also Replacing The Faucet Attachment With An Older Used Replacement Even Though The One On There Is New, Go Figure. They Refuse To Insulate The Pipe’s In The Wall, The Culprit Of This Present Issue And The Reason Why They Will Continue To Come Back As Soon As The Temperature Hit’s The Freezing Point Of 32 Degree’s.

Here Is The Latest Update On The Frozen Pipe Situation:

After Arriving At 6P.M. Last Night, The Landlord And His Dutiful Father In Law, The Same One That Lowered My Kitchen Window To Yell At Me About Having The Window Opened And Complaining About Lack Of Heat, Yeah That One…Anyway They Arrived To Fool Around With The Now 1 Year Old Issue Of Frozen Pipes…Perplexed At How Is It Possible For The Pipe To Freeze If They Finished The Basement Wall’s And Ceiling…..Well I Kept On Advising Them That The Kitchen Sink Was Installed Adjacent To A New Sheetrocked Wall That Was Installed Without Insulation, Hence The Frozen Pipes. They Consulted With Each Other For About 20 Minutes….Shuffled Back And Forth, Here And There….Then The Father In Law Realized Gave A Huff, Realizing After Removing The Flexible Water Line To The Faucet That Indeed It Was The Copper Water Pipe Itself Protruding From The Really Cold Wall That Was FROZEN!!!!!!!….

Imagine My Suprise At His Discovery And The Amazement In My Own Mind At Witnessing Such An Discovery….Shit I Almost Pee’d In My Pant’s At The Sight….Containing My As Yet To Erupt Amusement And Laughter On Noticing The Worry And The Realization of The Daunting Work That Faced Him, I Aquicended And Stated That I Can Last One More Day With This Issue Being Resolved But That They Must Promise Me To Return The Next Day To Correct This Ongoing Issue And Finally Put It To Rest.

Well Not Knowing What Work The Old Man Had Performed, Imagine My Suprise When I Turned On The Hot Water And Only Cold Water Spewed Out Of The Kitchen Faucet…I Was Literally Shock Into Conscienseness While Yet Perplexed….I Immidiately Bent Down To Look Under The Kitchen Sink Thinking That The Old Man Had Disconnected The Wrong Connection And Low And Behold I Witnessed Something Extraordinary, Something That Never In My 46 Years Have Ever Witnessed Before, Yes I Have Seen It In An Electrical Circuit Perhap’s, But Never In My Wildest Dream’s Would I Have Even Concieved Of Such A Ingenious Idea….Here Is This Handy Work:

Today I Woke Up To Have A Cup Of Joe, Only To Discover That I Had No Running Cold Water…Of Course I Kind Of Expected This To Be The Next Issue As I Remember Around This Time Last Year That I Wrote About This Issue Before…. I Went Back To My Post’ And Lo And Behold Here It Is, I Wrote This Back On January 24, 2011 And At That Time Both The Hot And Cold Water Pipes Were Frozen. 

Perhaps This May Be The Reason Why Nothing Works In NYC With Mayor Michael Bloomberg (The Crook) Of N.Y. Who Has For The Past 12 Year’s, As The Billionaire Mayor Of N.Y.C., Deliberately And Criminally Ignored The Needs Of The City’s Poor And The Countless Homeless Families. Bloombito Decides Instead, Being The Greedy And Hitler’s Personage That He Is, Deep Down Inside, He Decides To Ignore Those Less Fortunate, To Instead Radically Funds Perks For The Wealthy, His Friends And If I May Say, Those Closest To His Skin Tone And Racial Make-Up, As Indicated By This Recent Revelation Here:

Well I Woke Up To Find That, Both The Hot Water Pipe And The Cold Water Pipe’s Were Frozen.

Seinfeld’s Soup Nazi Has Struck Again, Only This Time It Is The Coffee Nazi. NO COFFEE FOR YOU!

I Now Have No Hot Water And No Cold Water. Funny That Mayor Bloomberg And Speaker Quinn, Both  Held A Press PR Blitz Touting The New And Improved HPD Initiative. I Posted This NEW Initiative’s Press Release A Little Earlier.

The Purpose Of This New Initiative And The Expected Outcome Is To Prevent Landlord’s From Shirking Thier Responsibilities To Their Tenant’s On A Timely Manner.

Let’s Use My Situation As An Example Of When This New Initiative Would Help The Lease Holder.

I Called HPD On Three Occasion’s For Insufficient Heating. HPD Inspector’s Came Two Time’s.

During The Last Inspection, The HPD Inspector Stated That The Landlord, If She So Chooses To, Can Remove The Only Floor Radiator In My Apartment, As Long As It Is Not In The Bedroom. He Also Stated that The Landlord Was Only Required To Give Me Heat In The Bedroom.

This Same Inspector Suggested That I File A Complaint Concerning The Hole In The Wall That Allow’s The Outside Cold Air To Enter My Apartment From Under the Sink Area. I Did File A Complaint With HPD On January 16th, 2011.

Guess What They Have Not Been Here Yet For That Call. And It Is Now January 24, 2011. A Good 168 Hour’s have Blissfully Gone By. Now I Know Why Those People Died During The NYC Blizzard Of 2010.

 Well This Would Have Been A Great Candidate, To Begin Mayor Bloomberg’s And Council Speaker Christine Quinn’s New And Improved HPD Initiative, Don’t You Think So.

In Any Case, I Called Both The Property Manager And The Landlord ( Who Lives In Pennsylvania). The Property Manager Called Me Back To Tell Me To Call Her When The Water Comes Back ON!

Icicle’s Are Forming Around My Window Sill. The Temperature Outside Is 14 Degree’s, With The Windchill Making It Around 8 Degree’s.

The Temperature In My Apartment Is Around 45 Degree’s, So I Cannot Stay Long With This Post.

The Landlord Has Not Repaired The Drafty Crack/Hole Underneath And Against The Sink Wall.

I Will Call 311/HRA Tomorrow. I Am Tired.

I Went To Bed And I Had To Use The Extra Comforter That I Borrowed From My Mom. I Borrowed It So That My Son Who To Visit December 26th 2010, Could Use It.

Now I Have To Use It. Never Slept Using Two Comforter’s Before.

That Is How Cold My Apartment Is.

I Am Freezing With a Big F.

Still No Repair’s And No Change In The Heating Pattern. Too Tired To Call 311 And HPD.
